It is quite evident that President Joe Biden has two clear motives, firstly working for the rights of the people and secondly reversing Donald Trump’s laws. The Department of Health and Human Service announced on Monday that The U.S government is will protect the LGBTQ community from being discriminated in health care. President Biden’s administration announced on Monday that it will be revising the policy introduced under former President Donald Trump. The policy limited protections for transgender people in health care.
Protecting the LGBTQ community’s health care
President Joe Biden’s intentions of reversing, the policy made by Trump is a great victory for the LGBTQ advocates. Donald Trump during his time removed the non-discrimination protection for the LGBTQ community in health care and health insurance was a clear act of injustice for the people. As Biden reverses the policy it bars the health care providers and health-related organizations from discriminating on the basis of someone’s sexual orientation and identity.
Health and Human Service Secretary Xavier Becerra said in a statement that,” The Supreme Court has made clear that people have a right not to be discriminated against on the basis of sex and receive equal treatment under law, no matter their gender identity of sexual orientation”.
The LGBTQ community is no different from normal people and everyone should be free from discrimination or interference and be capable of availing health care. Removing the non-discrimination policy is completely being unfair to the community, as it restricts them form health care which can lead to serious consequences due to negligence.
The announcement regarding the rule on Monday means that the HHS office will again start investigating complaints of sex discrimination for Civil Rights. Discrimination on the basis of sexual orientation and gender identity is to be looked after from now on according to Biden’s administration. Hospitals, clinics and other medical providers have to face government sanctions for violation of the law.
More essential for transgender people
The policy announced by Biden’s administration is nonetheless restoring the policy established during President Obama. The policy was known as the Affordable Care Act which included a prohibition on sex discrimination in health care. The Obama administration interpreted the law as a shield for transgender people. It believed that the sexual orientation of people was shaped by their inner sense of being male or female.
Transgender people go through a medically recognized condition called “gender dysphoria” which is discomfort and distress caused by a discrepancy between that person gender assigned by birth and the gender the person identifies. This can lead to severe depression and treatments can range from gender confirmation surgery and hormones to change outward appearance.
Thus, if the transgender community which is more than 1.5 million Americans are refused to health care on the basis of discrimination then its widely unfair.
